Stratocheck

Terms of Service

Effective date: September 19, 2026

Last updated: October 28, 2026

These Terms of Service (these "Terms") form a binding agreement between you and Domisomi LLC ("Domisomi," "we," "us," or "our") governing your use of the Stratocheck service (the "Service"). The Service includes the Stratocheck iOS application (the "App"), the servers that support it, and the interfaces that accept a personal access token, currently a Model Context Protocol endpoint and a forecast API (together, the "API").

By tapping "Agree and Continue" in the App, or by otherwise using the Service, you agree to these Terms. If you do not agree to these Terms, you may not use the Service.

Section 15 contains a binding arbitration agreement and a class-action waiver that affect how disputes between you and Domisomi are resolved. You may opt out of the arbitration agreement within 30 days, as described in Section 15.6. Please read Section 15 carefully.

1. Description of the Service

Stratocheck is a short-range cloud forecasting ("nowcasting") service. A machine-learning model analyzes recent GOES satellite imagery and estimates the probability that the sky above a specified location will remain clear, or will become clear, over the next few hours. The model reads that imagery on a grid of cells several kilometers across and follows cloud systems at that scale, which limits the size of the clouds it can see. Section 3.4 describes what that means for the forecast you receive. We may change how often forecasts are updated, how far ahead and in what intervals they forecast, and the resolution of the model's grid.

The Service is not a general weather forecast and is not a substitute for one. Although it uses satellite data published by the National Oceanic and Atmospheric Administration ("NOAA"), the Service is not a product of, and is not affiliated with or endorsed by, NOAA, the National Weather Service, or any other government agency. Forecasts are available only for locations in the contiguous United States.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 years old, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms. You must have the legal capacity to enter into these Terms.

3. Nature of Forecasts; Assumption of Risk

This Section describes the limitations of the Service's forecasts and the risks you accept by relying on them. Please read it carefully.

3.1 Forecasts are probabilities. Each forecast is an estimate of probability, not a guarantee of any outcome. For example, a forecast of 85 percent means an estimated 15 percent chance of a different outcome. A forecast that does not come true is therefore consistent with the normal operation of the Service and does not, by itself, indicate a defect.

3.2 Historical accuracy. We may publish records of our forecast accuracy, including forecasts that proved incorrect. Any such records describe the model's past performance only. They are not a warranty, guarantee, or prediction of the accuracy of any future forecast for any particular location or time.

3.3 Errors and interruptions. The Service may be inaccurate, out of date, degraded, or unavailable. We do not offer a service-level agreement, and we do not guarantee any level of uptime, availability, or response time for the App or the API. An outage or degraded service does not entitle you to a refund or service credit; refunds are governed by Section 5.5. Satellite data feeds and ground stations may fail, imagery may arrive late or corrupted, and the model may produce incorrect forecasts. The model infers the state of the sky from satellite imagery, and it cannot always tell from that imagery what the sky actually holds. Some conditions are harder for it than others, such as fog and thin or newly forming cirrus clouds, and those examples are not a complete list. The App displays indicators of forecast freshness and confidence, and you are responsible for taking them into account.

3.4 Scale of the forecast; small and local clouds. The model tracks cloud systems at the scale of the satellite imagery it reads, in grid cells several kilometers across. A forecast therefore describes the sky over an area several kilometers wide, averaged across that area, and not the sky at the single point you selected. Clouds smaller than that scale, or shorter-lived than the interval between satellite images, may not appear in the data available to the model at all. An isolated cumulus cloud, a patch of fog in a valley, a contrail, a lenticular cloud over a ridge, or a cloud that forms and dissipates within a few minutes may pass overhead without being reflected in your forecast, and the Service may report clear sky while such a cloud blocks your view. The reverse is also possible: the sky above you may be clear while the Service reports cloud cover nearby. Conditions can also differ over short distances because of terrain, elevation, bodies of water, and local heating, so a forecast for your location may not describe the sky a few miles away. A forecast is a statement about cloud cover across an area over a forecast interval. A forecast of clear sky is not a guarantee that no cloud will be overhead at any given moment, and a forecast of cloud cover is not a guarantee that the sky will not clear. A cloud that the Service did not show, or clear sky where it showed cloud, does not, by itself, indicate a defect.

3.5 Intended use; prohibited high-risk uses. The Service is intended for general information and for planning personal activities such as stargazing, astronomy, and photography. You may not use the Service for aviation, including the operation of drones or other unmanned aircraft, marine navigation, commercial agriculture, emergency management, search and rescue, public-safety decisions, construction or industrial safety, or any other purpose in which an error could contribute to death, personal injury, or significant property or financial loss. The Service is not designed, tested, certified, or insured for any such use, and Domisomi expressly disclaims all liability arising from any such use.

3.6 Official warnings. The Service is not a substitute for official weather warnings. For severe weather, rely on the National Weather Service and your local emergency authorities. The Service does not detect, predict, or warn of lightning, tornadoes, hail, flooding, wind, wildfire, or any other hazard. It estimates cloud cover only.

3.7 Responsibility for your decisions. Any decision you make, and any activity you undertake, in reliance on the Service is your own. Most activities carry risks that have nothing to do with cloud cover, such as travel, darkness, terrain, other weather hazards, and the equipment you use. You are responsible for assessing conditions, exercising your own judgment, and ensuring your own safety.

4. Accounts

The core forecast is available without an account. An account is required to save sites, synchronize data across devices, maintain a subscription, or create an API access token.

Accounts are created through Sign in with Apple. You are responsible for maintaining control of your Apple Account and your devices, and for all activity that occurs under your account. If you believe that your account has been compromised, you must notify us promptly at [email protected].

Each account is for use by one individual. You may not share your account credentials or allow any other person to use your account.

5. Subscriptions and Billing

5.1 Service tiers. The Service is offered in a free tier and one or more paid tiers ("Stratocheck Pro"). The features included in each tier are described in the App and may change as described in Section 11.

5.2 Payment through Apple. Subscriptions are sold through the Apple App Store. Payment is charged to your Apple Account when you confirm your purchase. We do not receive or process your payment information.

5.3 Automatic renewal. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current subscription period. Your Apple Account will be charged for renewal, at the then-current price, within the 24 hours before the end of the current period.

5.4 Cancellation. You may manage or cancel your subscription in your Apple Account settings. We are unable to cancel a subscription on your behalf. Cancellation stops future renewals, and you will retain access to Stratocheck Pro features until the end of the period for which you have already paid. Deleting the App does not cancel your subscription.

5.5 Refunds. Refunds are handled by Apple in accordance with Apple's policies. Except where required by law, payments are non-refundable, and we do not provide refunds for partial subscription periods. If Apple refunds or revokes a purchase, the corresponding entitlement will end.

5.6 Price changes. We may change subscription prices. Apple will notify you of any price change and, where required, will obtain your consent before the new price applies to a renewal. A price change will not apply to any period for which you have already paid.

5.7 Free tier. The free tier is provided as is, and we may modify or discontinue it at any time. We will not reduce the features of a paid subscription during a period for which you have already paid, unless we discontinue the Service entirely. This does not apply to the rate limits, daily request limits, and other usage limits of the API, which we may change at any time as described in Section 7.

5.8 Free trials and promotional offers. A free trial converts to a paid subscription at the end of the trial period unless you cancel before the trial ends. Unless we state otherwise, each Apple Account is eligible for only one free trial.

6. Acceptable Use

You agree that you will not:

We may suspend or terminate your access to the Service for any violation of this Section, and we may apply rate limits, quotas, and other abuse controls at our discretion.

7. API and Agent Access

If you create a personal access token for the API, the following terms apply:

If you connect the Service to a third-party AI agent or other client software, you are responsible for how that software uses your token and the forecast data it receives. We do not control third-party software.

8. Intellectual Property

8.1 Our property. The App, our servers and software, our models and model weights, forecast output, verification data, designs, and the Stratocheck name and marks are owned by Domisomi and are protected by intellectual property laws. These Terms do not transfer ownership of any of them to you.

8.2 License to you. Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial purposes. To use the Service for a business or other organization, you need our written permission, which you can request at [email protected].

8.3 Third-party data. GOES satellite imagery is produced by NOAA/NESDIS and, as a work of the United States Government, is in the public domain. Place-name data is derived from GeoNames and is used under a Creative Commons Attribution license. Our processing of this data, our model, and our forecast output belong to Domisomi.

8.4 Your content. You retain ownership of the site names and token labels you enter. You grant us a limited license to store and process that content as necessary to operate the Service.

8.5 Accuracy statistics and marketing. We may publish aggregate accuracy statistics and comparisons of our forecasts with observed conditions. These materials are derived from our forecasts and satellite imagery, not from identifiable user activity. We will not use your saved sites, your usage history, or any content that identifies you in marketing materials without your separate, explicit consent, which you may withdraw at any time.

8.6 Feedback. If you submit suggestions or other feedback about the Service, we may use that feedback without restriction and without compensation or obligation to you.

9. Privacy

Our Privacy Policy describes the information we collect and how we use it. The Privacy Policy is incorporated into these Terms by reference.

10. Third-Party Services

The Service relies on services provided by Apple and Amazon Web Services and on data feeds provided by NOAA. We are not responsible for the availability, performance, or acts of these third parties. Your use of the App Store is governed by Apple's terms and conditions.

11. Changes to the Service and to These Terms

Subject to Section 5.7, we may modify, suspend, or discontinue any part of the Service. We will make reasonable efforts to give advance notice of any material reduction in the features available to paid subscribers.

We may amend these Terms. We will post the amended Terms with a new effective date, give notice in the App before material changes take effect, and ask you to accept the amended Terms in the App. If you continue to use the Service after the amended Terms take effect, you accept them. If you do not accept the amended Terms, you must stop using the Service and cancel any subscription.

12. Termination

You may stop using the Service at any time, and you may delete your account at any time in the App.

We may delete your account if it has had no activity for 24 months. Activity means signing in, using the App while you are signed in, including when it refreshes in the background, or using one of your API tokens. We will not delete an account for inactivity while it has an active Stratocheck Pro subscription, and the 24 months begin no earlier than the end of your last subscription period. Because we do not collect your name or email address, we cannot warn you before we delete an inactive account. The deletion is permanent and has the same effect as deleting the account yourself, as described in Section 7.2 of our Privacy Policy.

We may suspend or terminate your access to the Service if you breach these Terms, if we suspect fraud or abuse, if required by law, or if we discontinue the Service. Where practicable and lawful, we will give you notice and an opportunity to cure the breach. If we discontinue the Service, we will give notice in the App before it ends where practicable, and you may ask Apple for a refund of any unused subscription period under Apple's policies.

Sections 3, 6, 8, 13, 14, 15, 16, and 17 survive any termination of these Terms.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, DOMISOMI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, DOMISOMI DOES NOT WARRANT THAT FORECASTS WILL BE ACCURATE; THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DOMISOMI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR OPPORTUNITY, WASTED EXPENDITURE, OR TRAVEL, EQUIPMENT, OR EVENT COSTS, ARISING OUT OF OR RELATING TO THE SERVICE, INCLUDING ANY DAMAGES ARISING FROM RELIANCE ON A FORECAST, EVEN IF DOMISOMI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

DOMISOMI'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS (US$100).

The limitations in this Section apply regardless of the legal theory on which a claim is based, and even if a limited remedy fails of its essential purpose. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for death or personal injury caused by our negligence, or for fraud. Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

You acknowledge that the limitations in this Section are an essential basis of the agreement between you and Domisomi, and that we could not offer the Service on its current terms without them.

15. Dispute Resolution; Arbitration; Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

15.1 Informal dispute resolution. Before commencing an arbitration or court proceeding, you must email [email protected] with a description of the dispute and the relief you seek. Domisomi will give you the same notice before commencing a proceeding against you. Both parties agree to attempt in good faith to resolve the dispute for 60 days after the notice is sent. Compliance with this Section 15.1 is a condition precedent to commencing arbitration.

15.2 Agreement to arbitrate. If a dispute is not resolved under Section 15.1, you and Domisomi agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, and not in court. The arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures or, if JAMS is unavailable, by another established arbitration provider on which the parties agree. The Federal Arbitration Act governs this Section 15.

15.3 Exclusions. This Section 15 does not apply to:

15.4 Class-action waiver. You and Domisomi each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is found unenforceable with respect to a particular claim or remedy, that claim or remedy will be severed from the arbitration and may proceed in court, and the remainder of this Section 15 will continue to apply. This waiver does not affect any right you may have to bring a representative action that cannot be waived under applicable law.

15.5 Procedure and costs. The arbitration will be conducted in English. If your claim is for $25,000 or less, it will be decided on the basis of written submissions alone unless you request a hearing, which may be conducted by telephone or video conference. If your claim is for $10,000 or less, Domisomi will pay your filing, administration, and arbitrator fees, unless the arbitrator finds that your claim is frivolous. In all other cases, fees will be allocated in accordance with the arbitration provider's rules. The arbitrator may award the same individual relief that a court could award, and the arbitrator's award will be final and binding.

15.6 Right to opt out. You may opt out of this arbitration agreement within 30 days after you first accept these Terms by emailing [email protected] with the subject line "Arbitration Opt-Out" and including your name. You may send the email from any address. There is no charge to opt out, and opting out will not affect your use of the Service. If you opt out, Section 16 will govern, and disputes will be resolved in the courts identified in that Section.

15.7 Changes to this Section. If we make a material change to this Section 15, the change will not apply to any dispute of which we had notice before the change took effect, and you may reject the change by emailing us within 30 days after it takes effect.

16. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. For any dispute that is not subject to arbitration under Section 15, you and Domisomi consent to the exclusive jurisdiction of the state courts located in Sacramento County, California, and the United States District Court for the district that includes that county, and waive any objection to venue in those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Nothing in these Terms deprives you of the protection of any mandatory consumer protection law of the place where you reside.

17. Apple App Store Terms

The following terms apply if you obtained the App from the Apple App Store. Your license to use the App is also governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"), which is an agreement between you and Domisomi. These Terms govern the rest of the Service, including the forecasts, your subscription, and the API, and how disputes between you and Domisomi are resolved, including disputes about the App (Section 15). If these Terms conflict with the Standard EULA, the Standard EULA controls as to your license to use the App, and these Terms control in every other respect. If any other provision of these Terms conflicts with this Section 17, this Section 17 controls.

  1. These Terms are between you and Domisomi only, and not with Apple Inc. ("Apple"). Domisomi, not Apple, is solely responsible for the App and its content.
  2. Your license to use the App is described in the Standard EULA.
  3. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
  4. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App, if any, to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
  5. Domisomi, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
  6. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Domisomi, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
  7. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

18. General Provisions

Severability. If any provision of these Terms is held to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be so modified, and the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment. You may not assign or transfer these Terms. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.

Entire agreement. These Terms and the Privacy Policy, together with the Standard EULA as to your license to use the App (Section 17), constitute the entire agreement between you and Domisomi regarding the Service and supersede any prior agreements on that subject.

Force majeure. We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including satellite or ground-station outages, failures of upstream data providers, network or cloud-provider outages, natural disasters, and acts of government.

Notices. We may give you notice through the App or, if you have written to us, at the email address you wrote from. Notices to Domisomi must be sent to [email protected].

Export control. You agree to comply with all applicable export control and sanctions laws.

Language. These Terms are written in English. If these Terms are translated into another language, the English version will control.

Contact. Questions about these Terms may be directed to Domisomi LLC at [email protected].
